What is International Criminal court that Palestinians want to use to prosecute Israel?

The ICC is NOT a court in any sense of the word. The ICC does not have rules of procedure by which it is bound. The ICC does not have set rules of evidence, does not forbid hearsay, does not guarantee the right to confront one's accusers, etc.... The ICC does not maintain strict separation between the prosecutors and the judiciary. Those tried before the ICC do not have juries of their peers deciding their guilt. There is no presumption of innocence at the ICC. The ICC is a Star Chamber which shrouded in secrecy and operates ony for political purposes. It is not a court of law. Participation in the ICC by American lawyers should be grounds for disbarment. The ICC is an insult to the very idea of justice and fair play.




Congress also could take action in response. Sen. Charles E. Schumer (D-N.Y.) said funding for Palestinians would be cut if they initiate an investigation of Israel. (Washington Post)

The State Department on Wednesday condemned the Palestinian Authority for signing the Rome Statute of the International Criminal Court. "We are deeply troubled by today's Palestinian action regarding the ICC," the department said in a statement, calling it a "counterproductive" move that "badly damages the atmosphere with the very people with whom they ultimately need to make peace."
